Terms & Conditions
These terms govern your use of Tracera, the analytics platform operated by GoTrust BV. By creating a Tracera account you accept them. They are written in plain English on purpose — if anything is unclear, ask before agreeing.
1. Parties & definitions
"We", "us", "Tracera" means GoTrust BV, Morelgem 24B, 9520 Vlierzele, Belgium, VAT BE 1037.576.138, registered with the Crossroads Bank for Enterprises.
"You", "Customer" means the natural or legal person who creates a Tracera account and accepts these terms.
"Platform" / "Service" means the Tracera analytics platform: tracker SDKs, ingest endpoints, query API, web dashboards, and supporting services available at tracera.eu, portal.tracera.eu and related subdomains.
"Visitor" means an end-user of a website or app on which you have installed the Tracera tracker.
2. The service in one paragraph
Tracera is a cookieless, EU-hosted analytics platform. You install our tracker on your site or app; we count visits and events without storing cookies on visitors, without persistent visitor identifiers, and without IP addresses. We report aggregated statistics back to you via the portal and the Query API. Your data is yours; we never sell or share it.
3. Account & eligibility
- You must be at least 18 years old and legally able to enter into a contract.
- If you sign up on behalf of a company, you confirm you are authorised to bind that company.
- You are responsible for the accuracy of the information you provide and for keeping your credentials secret.
- You are responsible for all activity on your account, including any sub-users you invite. Use the role system (RBAC) to limit access appropriately.
4. Free trial & subscriptions
- New accounts start on a 14-day free trial. No payment method is required to start.
- At the end of the trial, you must add a valid payment method (via Stripe) to keep using the platform. Otherwise write operations are disabled and your dashboards become read-only.
- Subscriptions are billed monthly or annually, in advance, in EUR. Prices are listed on our pricing page.
- You can cancel at any time from the portal. Cancellation takes effect at the end of the current billing period; no pro-rata refunds for the current period.
- We can adjust pricing with at least 30 days' notice. Existing paid subscriptions keep their current price until the next renewal.
5. Invoicing
Invoices are issued by GoTrust BV via our own billing platform. For Belgian customers with a valid VAT number, invoices are delivered through the Peppol network in addition to PDF. All invoices are available for download in the portal under Billing & plan.
6. What you may do with the platform
- Install the tracker on websites and apps you own or operate on behalf of clients.
- Read your own data via the portal, the Query API, or downloadable exports.
- Invite team members or service accounts and assign them roles.
- Build dashboards, reports, alerts, and embedded views for yourself or your clients.
7. What you must not do
- Send events you did not collect yourself, or events designed to inflate the analytics of someone else's account.
- Use the platform to identify, profile, or fingerprint individual visitors. Tracera is built to make this impossible by design; do not try to work around it.
- Reverse-engineer, decompile, or attempt to extract source code beyond what is published openly.
- Resell raw Tracera data to third parties without our prior written consent (white-labelled dashboards delivered to your own clients are fine).
- Use the platform for anything illegal, including but not limited to spamming, malware distribution, or hosting content that violates third-party rights.
8. Data ownership & portability
You own your data. We process it on your behalf as a data processor (see our DPA). You can export your data at any time in CSV, JSON, or Parquet via the portal. We do not gate exports behind a paywall.
If you stop being a customer, we keep your data available for export for 30 days, then delete it. Backups are purged within an additional 30 days.
9. Service availability
We aim for high availability but make no uptime guarantee in these standard terms. We publish ongoing platform status; planned maintenance is announced in advance where possible. If you have a contractual SLA need, please contact us first — we do not pretend to offer one in this standard agreement.
10. Privacy & security
How we handle personal data is explained in detail in our privacy policy. The processor-side relationship for visitor data on the Tracera platform is governed by our Data Processing Agreement (DPA), which forms part of these terms.
We apply reasonable technical and organisational measures to protect customer data. We are not pretending to be ISO 27001 certified or any other formal certification; we will be transparent if and when that changes.
11. Liability
To the maximum extent permitted by Belgian law, our total liability for any claim arising out of or related to the service is capped at the fees you have paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or punitive damages, including lost profits or lost data.
Nothing in these terms limits our liability for fraud, intentional misconduct, gross negligence, or damage to persons.
12. Suspension & termination
We can suspend or terminate your account if you materially breach these terms (including non-payment), or if your use of the platform endangers other customers or the infrastructure. We will give you reasonable notice and a chance to fix the issue where possible.
You can terminate your account at any time from the portal. Upon termination, you remain liable for any unpaid fees up to the end of your current billing period.
13. Changes to these terms
We can update these terms. Material changes are announced by email and shown in the portal at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
14. Governing law & jurisdiction
These terms are governed by Belgian law. Any dispute that cannot be resolved amicably will be brought before the courts of the judicial district of Ghent (Dendermonde division), Belgium, except where mandatory consumer-protection law gives a consumer the right to a different forum.
